Keep it Legal Legislation is a committee formed to aid and support the PAC RATPAC (repeal assembly tactics). Our goal,
in conjunction with RATPAC (pls visit ab839.tripod.com for that website) will be to see that new legislation is introduced
and passed to ensure our industry will never again be faced with threats of equipment confiscation, prosecution, and the loss
of our livelihoods. We also will work for the election of officials sympathetic to our cause. (McClintock, Schwarzenegger,
and Jerry Brown foremost).
We urge you to log onto sites and view information on California Penal Code 330-337J. Current interpretation of these
codes by the Attorney General Lockyer tells us everything we are doing is illegal, we are all guilty of misdemeanor crimes
($1000.00 fine and 6 months jail is maximum penalty for misdemeanors) and basically no type party we operate or work at is
lawful.
However, the ambiguity in the code is that to be considered illegal the games must be played for money, cheques (chips
which have a dollar value) credit (a marker) or other representative of value. Representative of value in legal terms has
always meant that there is an exchange value inherent in the transaction. Since we place no value on our chips or tokens,
there is no exchange value for any winnings. And even if we issue raffle tickets, there is no even exchange for the tickets-the
tickets only represent an opportunity to win something, and raffles are legal in California.
Our other goal is to educate all of the people whom this issue effects, and enlist their support in educating other people
who will vote. The multiplier effect of only 50 determined people can move MILLIONS MORE!
This is a business for some of you, a good part time income that is fun for some of you, and a customer base for others.
While we are often competitors in the market, we can all come together when our freedom to operate a business that does no
harm or to work in that industry is threatened by bureaucrats and politicians who choose to empire build, or align themselves
with monied gambling interests to further their careers.
